Terms of Use
Chapter 1 General Rules
- Article 1 (Purposes)
- The purpose of these service terms and conditions is to set forth the terms and conditions of use and the procedures for using all the services provided by the website of the Gyeonggi Arts Center (“the website” hereinafter), the rights, duties and responsibilities of the users and the website, and other matters required for its use.
- Article 2 (Validity and amendment of the terms)
- 1. The website shall provide you with the membership service of the Arts Center when you agree to these terms and conditions. When you agree to these terms and conditions, they shall be preferentially applied to the Arts Center's acts of providing the website services and your acts of using the services.
- 2. These terms and conditions may be modified without advance notice. The modified terms and conditions shall be published on the website or notified to the users by other means. The modified terms and conditions shall enter into force upon their publication or public notice.
- 3. The members may withdraw their membership registration when they do not agree to the modified terms and conditions. When they continue using the website service, they shall be regarded as having agreed to these modified terms and conditions.
- Article 3 (Applicable rules other than these terms and conditions)
- 1. These terms and conditions shall be applied together with the service regulations and other separate terms and conditions for the use of the services provided by the Arts Center.
- 2. Matters or items that are not provided under these terms and conditions shall be subject to the provisions of the Personal Information Protection Act, the Framework Act on Telecommunications, the Telecommunications Business Act, and other related statutes.
- Article 4 (Definition of terms)
- The terms used in these terms and conditions are defined as follows:
- 1. Users: Those who use the services provided by the Arts Center’s website based on these terms and conditions
- 2. Subscription: The act of validating the service contract by filling in the relevant information on the application form provided by the website to agree to these service terms and conditions
- 3. Members: Those who are authorized to use the services provided by the website among those who have completed their membership registration by providing their personal information to the website
- 4. ID: A combination of letters and numerals submitted by the members and approved by the website for their identification and use of the services
- 5. Password: A combination of letters and numerals selected by the users to protect their secrets on the network by checking that the user data match their ID
- 6. Withdrawal: The users’ act of terminating the service contract
- Terms that are not defined under these terms and conditions are defined under separate terms and conditions for the individual services.
Chapter 2 Service Contract
- Article 5 (Constitution of service contracts)
- 1. The service contract shall be constituted when the users fill in the information required on the subscription form provided by the website online.
- 2. The website may revoke a service contract when the user falls under any of the following:
- 1) When a user applies for the subscription using another person’s name;
- 2) When a user provides false information on the subscription form for the service contract;
- 3) When a user makes the subscription in such a way that it obstructs the public order and good customs of society;
- 4) When a user commits acts that are prohibited under the related statutes or these terms and conditions using the service; or
- 5) When an applicant fails to satisfy other requirements provided by the website.
- 3. The Arts Center may hold the constitution of the service contract until the cause is resolved in any of the following cases:
- 1) When the overall capacity of the service system is limited;
- 2) When the system has a technical error-related cause; or
- 3) Other cases where the Arts Center determines it necessary.
- Article 6 (Benefits of the members)
- The Arts Center shall provide the members with the following benefits:
- 1. It shall not impose any service fees on the purchase of service tickets reserved through the website in advance. However, the policy concerning the purchase of reserved service tickets may be changed after notifying the members in advance.
- 2. The members may use the bulletin board on the website and be provided with opportunities to participate in events. However, the terms and frequency of such participation may be limited based on the event operation policy.
- 3. Only those who have consented in advance shall be provided with short text messages or information concerning the Arts Center’s performances or events on their mobile phones on a regular or irregular basis.
- Article 7 (Revision of contract terms)
- 1. In the event of a change in the information the users have indicated on their service subscription, they shall correct the information personally or request the Arts Center to update their information.
- 2. The Arts Center shall not be held responsible for any damages caused by the members’ failure to correct or update their personal information as provided under the foregoing paragraph 1.
Chapter 3 Withdrawal from or Deprivation of Membership
- Article 8 (Withdrawal from membership)
- 1. The members may request their withdrawal from membership at any time using the My Page menu of the website. The Arts Center shall immediately process the withdrawal, except in the following cases:
- 1) When there exists a cause for which the applicant’s withdrawal must be refused based on a statute; or
- 2) When any fee payment is outstanding for services, including fees outstanding for attendance at Academy classes or the purchase of tickets
- 2. When service discontinuance is requested as provided under subparagraph 2, the Arts Center shall process the withdrawal after settling the outstanding service fees based on the reimbursement policy. When a member requests continued use of the relevant service, the Arts Center may refuse such request until the relevant service has been terminated. In such cases, the member should express his withdrawal intention anew when the service is terminated.
- 3. When a member withdraws from the service contract, the Arts Center shall immediately delete his/her personal information. The member may not request the recovery of the deleted personal information.
- 4. The Arts Center may archive a user's personal information for a period provided under its personal information handling policy when the personal information needs to be retained based on the related statute even when the user withdraws from the service contract. The user may review the information but may not request its correction or deletion.
- Article 9 (Loss of membership qualification)
- When a member falls under any of the following causes, the Art Center may restrict or suspend that user’s membership:
- 1. When a member has provided false information for his/her subscription;
- 2. When a member is involved in a crime;
- 3. When a member has stolen an ID or password belonging to another person(s);
- 4. When a member maliciously obstructs operation of the service;
- 5. When a member registers against using another ID;
- 6. When a member circulates contents that disturb the public order or good customs;
- 7. When a member defames other persons or causes disadvantages to others; or
- 8. When a member purchases tickets or applies for participation in events using false information, unlawful means or abusing his/her membership.
Chapter 4 Provision and Use of Services
- Article 10 (Use of services)
- 1. The service shall be available for 24 hours each day throughout the year unless the Arts Center experiences any extraordinary operational or technical failures.
- 2. The Arts Center may limit the service hours on a day or for a number hours for periodic inspection or other causes.
- Article 11 (Discontinuance of service)
- 1. The Arts Center shall not be held responsible in the event that the contents kept on its service website are deleted due to a national emergency, power failure, errors experienced by service equipment outside its control, other force majeure, or when other communications data are lost.
- 2. The Arts Center may suspend its service by notifying the users two weeks in advance when the service has to be suspended temporarily due to difficulties that disable its normal provision of services. The Arts Center shall not be held responsible for damages caused by the users' failure to read the notice during such period. The period of advance notice may be shortened or skipped when it is inevitable. The Arts Center shall not be held responsible even when any contents kept on this service are deleted due to the suspension of the service or when other communications data are lost.
- 3. The Arts Center may temporarily revise or modify its service after notifying the users in advance. The Arts Center shall not be held responsible by any users or third parties for such revision or modification.
- 4. The Arts Center may, at its discretion, restrict or suspend its provision of the service to a member who commits acts that violate these terms and conditions.
- Article 12 (Articles uploaded by the members)
- 1. The Arts Center may delete articles uploaded by the members without advance notice if they are believed to fall under any of the following:
- 1) When they contain defamatory or malicious comments that may damage the reputation of other users or third parties;
- 2) When they violate the public order or good customs;
- 3) When they infringe any copyright or other rights belonging to the Arts Center or third parties;
- 4) When they exceed the display period set by the Arts Center;
- 5) When they include commercial contents or false information;
- 6) When same articles are uploaded repeatedly; or
- 7) When they are believed to violate other related statutes
- 2. Members who upload articles shall hold the rights and responsibilities to such articles, whereas the Arts Center may not use them for any profit-seeking purposes other than uploading them on its website. However, this shall not apply to non-profit cases.
- 3. The Arts Center shall reserve the right to relocate and display them within its website.
- Article 13 (Copyright of uploaded articles)
- The members shall not use the data uploaded on the website for commercial purposes, including the processing or sale of information obtained by using the website services.
Chapter 5 - Duties of the Contract Parties
- Article 14 (Duties of the Arts Center)
- 1. The Arts Center shall display these terms and conditions, its trade name and the name of its representative, address (including the contact address for handling consumer complaints), phone number, taxpayer registration number, etc. on the homepage of its website. However, these terms and conditions may be shown on linked screens.
- 2. The Arts Center does not commit any of the acts prohibited under the statutes or these terms and conditions as they are deemed to violate the public order. The Arts Center also does its utmost to provide steady and stable services as provided under these terms and conditions.
- 3. The Arts Center shall allow the members to use the service on the service days requested by them unless there are unusual circumstances for not allowing it.
- 4. The Arts Center shall not disclose or distribute the members’ personal information to others without obtaining their approval in advance. However, this shall not apply in cases where such disclosure or distribution is demanded by a government agency based on the statutes related to telecommunications services.
- 5. The Arts Center shall install security systems to protect the members’ personal information and to ensure that they can use the Arts Center’s services safely.
- 6. The Arts Center shall treat inconveniences or complaints filed by the users based on the given standards when they are believed to be justified. However, the Arts Center shall not be responsible for a service failure that occurs due to a cause attributable to the members.
- Article 15 (Duties of the members)
- 1. The members shall comply with the obligations and responsibilities notified by the Arts Center, including the provisions of the related statutes and these terms and conditions. They shall not commit any acts that interfere with or hinder the Arts Center’s operations.
- 2. The members shall be responsible for maintaining the confidentiality of the information they enter from the moment they complete the subscription procedure, and shall be responsible for all consequences arising in connection with the use of their ID and password.
- 3. The members shall not commit any of the following acts while using the Arts Center’s services:
- 1) Acts involving the unlawful use of another member’s ID;
- 2) Acts of copying or using information obtained from the services for commercial purposes, in publications or broadcasting, or acts of providing such information to any third parties;
- 3) Acts that infringe any copyright or other rights belonging to the Arts Center or third parties;
- 4) Acts that cause a failure of the network equipment or that destroy information;
- 5) Acts that are objectively believed to be linked with crimes;
- 6) Acts that damage the public order or good customs;
- 7) Acts that defame or insult others; or
- 8) Other acts that violate the service terms and conditions provided the Acts Center or the related statutes.
- Article 16 (Security of members’ information)
- 1. The members shall be responsible for maintaining the confidentiality of the information they enter from the moment they complete the procedure for subscribing to the Arts Center’s website services. They shall be responsible for all consequences arising in connection with the use of their ID and password.
- 2. In the event that members discover that their ID or password has been used unlawfully, they shall reports such fact to the Arts Center immediately, and shall be responsible for any damages incurred by their failure to report such discovery.
- 3. The members shall duly terminate their connection whenever they end their use of the Arts Center’s website service. The Arts Center shall not be held responsible for damages or losses caused by the use of their personal information by third parties due to their failure to duly terminate the connection.
- Article 17 (Consent to use of members’ personal information)
- When the members subscribe to the website services based on these terms and conditions, they shall be regarded as having consented to the Arts Center's collection and use of their membership data indicated on the subscription form. The membership information on the Arts Center website shall be protected based on the Personal Information Protection Act and be used and managed as follows:
- 1. Use of personal information: The Arts Center does not disclose or distribute the personal information of its members collected in connection with the provision of its services to any third parties without their approval.
However, this shall not apply when it is demanded by a government agency based on the Framework Act on Telecommunications and other statutes, when it is for the investigation of crimes, when it is requested by the Information Communication Ethics Committee, when it is requested based on the procedures provided by other statutes, or when personal information provided by the members to the Arts Center is disclosed by themselves.
- 2. Management of personal information: Only the members may review, correct or delete their personal information on the personal information management menu on the website. Personal information is managed exclusively by the members’ ID and password. Therefore, the members should not disclose their ID or password to any third parties, and they should always close the web browser screen after duly logging out whenever they finish their work [connection] without fail.
Chapter 6 - Miscellaneous
- Article 18 (Ownership of the Arts Center services)
- 1. The Arts Center holds the ownership of the intellectual property rights or other rights related to the services it provides, and the software, image, marks, logos, designs, service names, information, trademarks, etc. required for such services.
- 2. The members shall not commit any acts of correction, rental, loan, sale, distribution, production, transfer, reassignment, creating security right, or commercial use of the assets provided under the preceding paragraph unless specifically approved by the Arts Center. They shall not allow any third parties to commit such acts.
- The members shall not use the materials uploaded on the service pages for commercial purposes, including the processing or selling of information obtained using the service.
- Chapter 19 (Damage compensation and immunity)
- 1. The Arts Center shall be responsible for damages incurred by the members due to the Arts Center’s or its employees’ willful intent or negligent performance of their duties based on the related statutes and business practices.
- 2. The Arts Center shall be exempt from responsibility for damages in the following cases:
- 1) When it is unable to provide the services due to a natural disaster or other equivalent causes of force majeure;
- 2) Failure of service provision by causes attributable to a user or other users;
- 3) The loss of expected return caused by the user's failure to use the services or damages caused as the user has depended on the information contained on the service pages; or
- 4) Damages caused by the unreliability or inaccuracy of the articles uploaded by members or the destruction. etc. of such articles
- Article 20 (Court jurisdiction)
- The law court having jurisdiction over the location of the Arts Center's main office shall have the exclusive jurisdiction when a lawsuit is filed against the Arts Center in a dispute related to the website services.
- <Addenda>
- 1. These terms and conditions shall enter into force on January 10, 2023.
- 2. The previous terms and conditions are replaced by these terms and conditions.
